Job Description
The Legal Advice and Legislation Branch (LALB) provides strategic legal advice and assistance to the Secretary, the Executive, and the line areas of the Department in relation to administrative law, statutory interpretation, regulatory compliance and legislative development.
The LALB also manages the Department’s Freedom of Information (FOI) processing function. Sections within the LALB advise on a broad and diverse range of the Department’s legislation including in aged care, medical and dental benefits, pharmaceutical benefits and private health insurance. Key legislation includes the Aged Care Act 1997, the Biosecurity Act 2015, the Health Insurance Act 1973, the National Health Act 1953 and the Dental Benefits Act 2008.
The Compliance & Administrative Section provides legal advice on compliance matters and administrative decision-making under Health portfolio legislation.
The Health Law Advice Section provides legal advice on statutory interpretation and other legal issues arising in program implementation under Health portfolio legislation.
The Compliance & Administrative Law and Health Law Advice Sections advise on a wide variety of Health portfolio Acts including legislation associated with Medicare, the Pharmaceutical Benefits Scheme, the Dental Benefits Scheme, Tobacco control, Biosecurity, Medical and midwifery professional indemnity schemes, Hearing services, Private health insurance and National health reform legislation. The Compliance & Administrative Law and Health Law Advice Sections are a part of the Legal Advice & Legislation Branch within the Legal & Assurance Division of the Department of Health and Aged Care.
