Job Description

The Legal Services section reports to the General Counsel/Chief Risk Advisor and supports the operations of the Clean Energy Regulator through the provision of dedicated in-house legal services.  The majority of the Section’s work relates to the interpretation and application of the climate change laws.  In particular, this involves statutory interpretation, the exercise of functions and powers conferred by those laws and the enforcement of those laws.

The Section also provides legal advice on the formulation and implementation of legislation and operational policy, identification and management of legal risks, and laws and policies relating to the operation of the agency (including the Public Governance, Performance and Accountability Act 2013, Freedom of Information Act 1982). The General Counsel is the principal purchaser of external legal services on behalf of the agency and is supported in this task by the Legal Services.

The Legal Services section is seeking to fill the role of Legislative Drafter / Senior Legislative Drafter.

We are seeking to offer a full-time position to a Legislative Drafter/Senior Legislative Drafter at an appropriate level, ranging from APS6-EL2. Opportunities will be available for both ongoing and, for a period of up to 12 months, non-ongoing basis. Whether a Legislative Drafter position (APS 6 level) or a Senior Legislative Drafter position (EL 1 or EL2 level) is offered will depend on the successful applicant’s experience.

We are looking for an experienced lawyer who, working under the supervision of a principal lawyer of the agency, is able to:

At the APS 6 level:

·         Draft simple and complex subordinate legislative instruments, including (but not limited to) methodology determinations under the Carbon Credits (Carbon Farming Initiative) Act 2011, and supporting explanatory statements

·         Provide clear and practical legal advice on a wide range of CER-specific legislation and general Commonwealth legislation

·         Manage and develop relationships with internal stakeholders (including the development and delivery of training packages)

·         Support the Legal Services & Governance Branch in achieving the objectives, and delivering on the strategic      direction of the Clean Energy Regulator.

At the Executive Level 1 (EL1), undertake the duties at the APS 6 level and:

·         Provide expert advice and have extensive understanding of legislation and policy frameworks.

At the Executive Level 2 (EL2), undertake the duties at the EL1 level and:

·         Be a strategic specialist, providing advice that influences strategic direction and have excellent understanding of legislative and policy frameworks and Commonwealth government decision making.

Applicants should be admitted as a legal practitioner in the High Court or the Supreme Court of an Australian State or Territory and should hold, or be currently eligible to obtain, a restricted practicing certificate issued by the ACT Law Society.
